1 - What is Willfinder.ca ?
Willfinder.ca has been established to provide a solution to the problem of locating Wills upon a person’s death. On many occasions, the deceased’s Last Will and Testament cannot be located. The determination of the location of the deceased’s most current last Will may at the best of times be very difficult. Lawyers, solicitors and persons whom the deceased has entrusted with possession of the deceased’s Will are not always made aware of the deceased’s death. In some cases, knowledge of the death may be intentionally or unintentionally withheld from persons having custody of the deceased’s most current last Will.

2 - What are the consequences of failing to locate the deceased’s most current Last Will and Testament?
In the event the deceased’s most current Last Will and Testament is not located, it is highly likely that:
• A previous Will, may be incorrectly recognized as representing the deceased’s Last Will and Testament, which may result in the failure of assets being transferred to persons whom the deceased in fact wished to benefit OR
• The administration of the deceased’s estate may proceed in accordance with the intestacy laws of the provincial government as a result of the failure to locate a Will. As a result, the deceased’s estate may be allocated to parties the deceased might not have wished to benefit.

Our firm suggests that your Will should be retained by your lawyer, solicitor, family members or trusted personal friends. Alternatively, such documents should be held in your bank safety deposit box or held in a fireproof security device of your choosing. No one will have access to the information contained within your Will unless you have provided it to them.

No, definitely not. Your Will is NOT available for anyone to see online as our firm will never have access to such documents. Our firm only retains information which you or your authorized representative provide to assist in determining the existence and location of your Will.

No. Any changes entered into the registry result in an additional record. Your initial registration and subsequent changes are never altered.

If you execute a new Will, it will be necessary for you to register such information to ensure all information relating to the existence and location of your Will remains current and up-to-date.

15 - What information will be disclosed relating to my affairs when a third party conducts a search?
Only information which you or your authorized representative has authorized our firm to provide to a third party conducting a search will be provided. A third party conducting a search will only be provided information concerning the existence of and location of your Will. The custodians in actual possession of your Will have full discretionary authority acting on your behalf to determine whether or not further information is provided when contacted by a third party after your death. This ensures that the contents of your Will remain safe, secure and confidential at all times.

17 - Who may conduct a search?
Any interested party may conduct a search; however, the party conducting a search will only be provided with information confirming the existence and location of your Will. No further information will be provided! The person or corporation having actual possession of your Will at the location designated in the search shall have full discretionary authority to decide what, if any, further information is provided to the third party subject to your prior instructions or wishes .
